Situation

We were contacted by a client involved in a road traffic incident where both his vehicle and a third-party vehicle were written off. An ambulance was called to the scene. The client was subsequently called in for an interview under caution by the police, who were considering prosecuting him for careless driving due to the serious nature of the incident at a 60mph junction.

The client was stressed and apprehensive as statements made during the police interview could be used as evidence in court.

Action taken

Upon initial contact, we advised the client about sentencing guidelines and factors affecting the seriousness of the charge. We arranged a consultation with our Police Station Accredited Representative. We corresponded with the police to obtain any advanced disclosure – such as dash camera footage – to understand the evidence against our client.

On the day of the interview, our client met privately with our representative, who explained the strength of the police’s evidence. We then presented representations to the police officer to mitigate and reduce the offence seriousness.

Outcome

A few weeks after the police interview, our client received a letter allowing him to take part in a Driver Improvement Course, thus avoiding prosecution.

Conclusion

Our client was thrilled with the outcome, keeping a clean licence thanks to our team of motoring specialists. This case highlights the importance of professional representation in stressful legal situations.
