An operator had been called to Traffic Commissioners Public Inquiry after a DVSA roadside stop had identified serious maintenance failings. On receiving the call in papers, the operator had sought expert advice from a reputable transport consultant and from Rothera Bray.
We worked closely with the operator and transport consultant to overhaul his systems, address compliance failings and carry our a full systems audit.
The operator was represented at the Public Inquiry by a specialist transport solicitor. He was able to explain to the Traffic Commissioner the extensive steps that had been taken by the operator to address failings and prioritise road safety. We were also able to explain the disastrous effect a licence revocation or suspension would have on the business.
After hearing from the operator and from our team, the Traffic Commissioner agreed not to revoke or suspend the Operators licence, but to impose a curtailment instead. This was an excellent outcome given the serious regulatory problems first uncovered during the DVSA investigation.
