This operator was represented at Public Inquiry by transport solicitor Chris Powell. Following an S-marked prohibition, the DVSA had conducted a compliance investigation. This uncovered among other failings, a lack of proper oversight on the part of the Transport Manager, inadequate roller break testing, and no evidence of refresher training having taken place.
Rotheras worked closely with the operator in the weeks leading up to the Public Inquiry to ensure proper systems and procedures were in place. A temporary replacement transport manager was engaged and the management of the business was restructured to prioritise regulatory compliance.
Notwithstanding the initial failings, the Traffic Commissioner was impressed with the steps that the operator had taken to improve matters. A formal warning was issued to the operator and no other action was taken.
