Situation
A parcel operator contacted us after being summoned to a public inquiry by the Traffic Commissioner for violations of drivers’ hours regulations.
Action taken
We visited the company’s operating centre to meet with the director and transport manager. We gathered information about the violations and represented the company at the virtual public inquiry.
We presented strong evidence showing the company’s efforts to correct the issues:
- The most problematic drivers were disciplined
- Enhanced tachograph analysis and missing mileage reports were implemented
- Drivers received additional training on defect reporting
- New policies were introduced to improve compliance
We argued that the company had not previously had any issues with the Traffic Commissioner and that this was an isolated incident involving six drivers. There were also no prior maintenance problems.
Outcome
The Traffic Commissioner was satisfied by our defence. Both the business and the transport manager received a formal warning and agreed to an independent compliance audit.
Conclusion
This was a favorable outcome for the business, as Traffic Commissioners typically impose harsher penalties for drivers’ hours offences.
