Situation
Our client approached us following a summons that he had received in respect of an offence of driving without due care and attention. Our client had overtaken an HGV and an SUV while crossing a solid white line.

Outcome
The Court concluded that while the offence was serious in nature, the mitigation that had been presented warranted leniency on this occasion. They took a view to impose the minimal penalty allowed within the sentencing guidelines. Our client received the lowest penalty for the offence and their licence was endorsed with 3 penalty points.
Conclusion
