We were instructed by an HGV operator who applied for a new operator’s licence but had run into difficulty with the Traffic Commissioner. The operator had a poor financial history and had been involved in a business that had gone into liquidation. There were concerns over financial standing and also questions around the operator’s good repute arising from a poor maintenance record.
The Traffic Commissioner had written to the operator proposing to call to public inquiry to look at the issues, inviting written representations. We met with the operator and advised upon the application and what compliance steps needed to be taken. We went through their systems and procedures, suggesting improvements and an operator licence compliance audit was obtained to demonstrate regulatory compliance.
The Traffic Commissioner accepted our detailed representations, granting the application with no regulatory action arising on the basis of the operator’s agreement to a DVSA investigation after six months. That proved to be a satisfactory maintenance investigation with no further action against the licence holder.
